The Website is the sole and absolute property of the company TRES – CIENTO DOS – NOVECIENTOS SESENTA MIL OCHENTA Y NUEVE SOCIEDAD DE RESPONSABILIDAD LIMITADA, legal entity number 3-102-960089, with registered office in San José, Montes De Oca, San Pedro, Avenida Diez, Calle Treinta Y Siete Bis, along with any intellectual and industrial property, images, designs, and any other elements exclusive to the Website.

If you wish to browse the public section of the Website, no prior requirements need to be met; however, to make inquiries or contract services through this electronic platform, you must fill out the forms provided on the contact pages.

Browsing the Website is completely free; however, please be advised that browsing the Website may result in charges from your telephone carrier, for which Assistmecr assumes no liability whatsoever.

User Age

Use of the Website is intended for adults or, in exceptional cases, minors under the strict supervision of their parents or guardians.

In the event of any suspicion of misuse of the website by any user, Assistmecr reserves the right to block said user, without prejudice to any legal actions that may be taken.

Suspension of Service

Assistmecr will strive at all times to ensure compliance with Costa Rican law. For this reason, it reserves the right to suspend services to any user of who acts in violation of these Terms of Use or who is reasonably suspected of doing so. All of the foregoing is without prejudice to any legal actions that Assistmecr may need to take to protect its rights or those of third parties, including seeking compensation for the actions committed by the offender.

User Obligations and Prohibitions

The User agrees that when using the Website, he or she will refrain from:

a) Using it in a manner, for purposes, or with effects contrary to the law, morality, and good customs, or for personal gain of any kind.

b) Violating the integrity of the Website through any type of action; without intending to be exhaustive, examples of prohibited actions include: attempts at sabotage, “hacking,” service saturation through manual means or the use of “robot” software tools, etc.

c) Reproducing or copying, distributing, allowing public access through any means of communication, transforming, or modifying the content of the Website;

d) To perform any act that constitutes a violation of the intellectual or industrial property rights belonging to Assistmecr or to third parties, such as the distribution, modification, or alteration of the Website’s content (texts, graphics, photographs, logos, icons, images), as well as the graphic design, source code, and software, whether these are the exclusive property of Assistmecr or owned by third parties.

e) Use the Website or the information obtained through it to advertise or engage in commercial activities for the purpose of direct sales or for any other purpose, whether commercial or otherwise;

If, as a result of the user’s failure to comply with these Terms and Conditions, Assistmecr or any third party suffers damages, the User shall be required to fully compensate the party that has suffered the damage.

Assistmecr’s Limitations of Liability

By using the Website, you acknowledge and accept the following limitations on Assistmecr’s liability:

1. We assume no liability for the activities or conduct of users.
2. Any action taken with a User shall be presumed to have been performed by said User, such that Assistmecr shall not be liable for any damages that may be caused by the acts of third parties if such acts are performed with its User.
3. The Website displays content from Assistmecr and other third parties (such as logos, trademarks, and other distinctive signs of business partners). Under no circumstances shall Assistmecr be held liable for the legality of third-party content displayed on the Website, as such content is included “as is.”
4. In the event that the Website’s content includes any hyperlinks providing access to third-party websites, such access to third-party websites is at your own risk.
5. If you believe that your intellectual or industrial property rights are being infringed by any content on the Website, you may contact Assistmecr to clarify the situation. However, with respect to third-party content, Assistmecr shall not be held liable if it is proven that the content in question infringed upon your rights in any way, given that, as stated above, content belonging to third parties is provided to Assistmecr “as is,” and therefore no liability whatsoever shall be accepted for such content.
6. Under no circumstances will Assistmecr be liable for any damages, including loss of profits and damages that may result from viruses, worms, or harmful programs or program components that may infect your computer while you are accessing or browsing the Website. Assistmecr hereby warns you that, although all relevant and appropriate security measures will be taken, on the Internet, no system, app, website, or any other type of online environment can be considered invulnerable to attacks by third parties. It is your responsibility to maintain your computer with the appropriate software to prevent infections while using our Website, and you therefore accept full responsibility and release Assistmecr from any liability in this regard.

Regarding Communications with Users

The processing of personal data and the sending of communications via electronic means comply with the regulations established in Law No. 8968 on the Protection of Individuals with Regard to the Processing of Personal Data and its Regulations.

Governing Law and Jurisdiction

These Terms and Conditions are governed by Costa Rican law. The parties submit to the courts and tribunals of Costa Rica.

All actions by Assistmecr or Users shall be deemed to have been taken within Costa Rican territory for all legal purposes.

These Terms and Conditions shall be governed by and interpreted in accordance with Costa Rican law in matters not expressly provided for herein.

User Acceptance

You are considered a “User” of the Website simply by accessing it; furthermore, by accessing it, you accept these Terms and Conditions as applicable and agree to comply with the provisions set forth herein. These Terms and Conditions shall remain in effect for as long as they are made available to Users; therefore, as soon as they are modified or updated in whole or in part, these conditions shall cease to be in effect, and the new terms of use shall govern the use of the Website. Furthermore, Assistmecr recommends reading this document prior to each use, as it reserves the right to modify the layout and configuration of the Website, as well as these Terms and Conditions of Use, at any time.
